General Terms and Conditions of ErlebensWert GmbH
§1 Scope of Application and Contracting Parties
These General Terms and Conditions govern the contractual relationships between ErlebensWert GmbH (hereinafter referred to as the “Agency”) and the host families as well as the aupairs (hereinafter also referred to as „Users“ or „Customers“) who are placed or brought into contact with each other via the Agency or its matching platform.
The Agency aims to place German-speaking au pairs with life experience (Senior Aupairs) with interested host families in Germany and abroad. The Agency’s activity constitutes a service, as it mediates and advises. The service ends with the mediation activity. There is therefore no entitlement to the actual conclusion of an aupair arrangement.
§2 Services of the Agency
I. Depending on the booked package, the Agency provides the following services:
Mediation of Senior Aupairs to host families abroad or in Germany, provision of suitable applicant profiles (possibly via a matching platform), support in the selection and contact initiation between aupair and host family, preparatory discussions and intercultural coaching, organizational support with travel planning, visa formalities, insurance mediation (no advisory service), as well as optional assistance with booking tourist services or language courses.
II. Scope of Services per Package
a) “Matching Portal”:
- Use of the matching portal for 3 months
- Independent creation and publication of a profile
- Insight into suitable profiles of Senior Aupairs or host families
- Independent contact initiation via the portal
The initial contract term is three months. After the first three months expire, the contract automatically extends at a price of €50 per month. The contract can be terminated with one month’s notice. Regardless of this, the contract term ends automatically at the latest after twelve months.
b) “Comfort Support” (all services from Matching Portal plus the following additional services):
- Personal initial consultation & profile advice
- Active mediation of a suitable match
- Support with initial contact
- Intercultural preparation (online workshop or group meeting)
- Information and tips on daily life, role understanding, and mutual expectations
- Support with contract design, travel preparation, insurance, and visa matters (costs for travel services, insurance, and visas are not included and must be paid separately)
- Reflection and follow-up after return
c) “Premium Support” (all services from Matching Portal and Comfort Support plus the following additional services):
- Individual coaching before departure (e.g., on motivation, role clarification, personal goals)
- Support with travel organization (outbound and return flight or journey, possibly language course and additional travel services — costs for travel services are not included and must be paid separately)
- Personal contact person during the stay (four pre-scheduled 1:1 video calls of 60 minutes each)
- Individual advice & support with challenges on site (quick availability via phone and WhatsApp)
- Individual follow-up support (one scheduled 1:1 video call of approximately 60 minutes) for reflection
III. Scope and Conditions for “Coaching”
a) Additionally or separately from the packages under II., coaching is offered under the following conditions:
(1) The content is fundamentally based on the coaching client’s needs.
(2) Multiple sessions may also be booked as separate coaching.
(3) Prices for coaching and advisory services depend on the respective scope and are agreed individually before coaching begins.
b) A booked appointment must be cancelled at least 24 hours before it begins. If cancelled more than 24 hours before the appointment, the client does not have to pay for the appointment. In this case, a replacement appointment will be arranged.
c) If a booked appointment is not cancelled in time (i.e., 24 hours before) by the coaching client or is terminated during the appointment, no replacement appointment needs to be offered and the appointment is forfeited. The claim for payment for the appointment remains valid or the payment is retained. There is no entitlement to a refund.
d) The Agency is entitled to cancel a coaching or package service due to illness or other reasons, provided no substitute can be arranged. In the aforementioned case, the Agency will first attempt to find a replacement date. If this is not possible, the client receives the coaching fee back. Further costs, such as any incurred accommodation and travel costs, are not covered.
e) If a coaching or training appointment is agreed outside the Agency’s location, reasonable travel and, if applicable, accommodation costs will be charged in addition to the fee.
f) The coaching program is based on cooperation and participation. Participation in the coaching program requires self-responsible willingness to learn. The Agency cannot guarantee any specific success for these processes. The client remains self-responsible for implementing the content and decisions developed during coaching.
g) The Agency is available as a contact partner throughout the entire mediation and coaching process.
§3 Fees and Payment Terms
(1) The prices for the services offered by the Agency result from the respective valid price offer or service description at the time of contract conclusion.
(2) For the use of the matching portal, the prices and contract conditions shown in the ordering process apply. The contract for the use of the matching portal is concluded between the Agency and the respective user. The use of the matching portal does not establish a contract between a Senior Aupair and a host family.
(3) Premium access to the matching portal is initially booked for a contract term of three months at a total price of €150 including VAT.
(4) After the first three months expire, the contract automatically continues at a price of €50 including VAT per month. During this continuation, the contract can be terminated with one month’s notice. Regardless of this, the contract term ends automatically at the latest after twelve months.
(5) Payment of fees is made via the payment service provider offered in the ordering process. The available payment methods are displayed to the customer in the ordering process. The customer authorizes the payment service provider to collect the agreed fees according to the chosen payment model.
(6) Payment for premium access to the matching portal is due upon contract conclusion. Monthly fees for the continuation of the contract are collected according to the agreed payment model via the payment service provider.
(7) Prices for individual support, advisory, and coaching services are communicated to the customer before contract conclusion. Unless expressly agreed otherwise, these services are to be compensated according to the respectively agreed payment conditions. The payment term is 10 days after receipt of invoice.
(8) The Agency is not a party to the contract between a Senior Aupair and a host family. The termination or non-execution of a Senior Aupair arrangement does not fundamentally affect the customer’s payment obligation to the Agency for services rendered, unless mandatory statutory rights dictate otherwise.
§4 Duty to Cooperate
Host families and aupairs have a duty to cooperate. This duty refers to the timely provision of information, documents, and all data the Agency requires to fulfill its task. A substantive review of the provided information is the responsibility of the host family and the aupair.
The Agency is entitled to temporarily restrict services or block access to the matching portal in accordance with these General Terms and Conditions if the user fails to perform required acts of cooperation despite reasonable request. §5 Withdrawal and Cancellation Policy
In the event that an aupair arrangement between host family and aupair is terminated by one party before the end of the agreed term, the customer’s payment obligations to the Agency for services rendered remain in effect, unless the Agency is responsible for the termination.
§6 Matching Portal
(1) The Agency operates a digital matching portal that brings together host families and Senior Aupairs and offers them the opportunity to get in touch, get to know each other, and initiate a possible stay as a Senior Aupair. The Agency thereby supports the personal exchange between host families and Senior Aupairs. There is no entitlement to the realization of a stay as a Senior Aupair or to a specific matching success.
(2) Access to the matching portal is activated after successful payment and completion of the Agency’s provided verification. The Agency is entitled to refuse activation if there are concrete indications of false or incomplete information, abusive use of the matching portal, or violation of legal provisions or these General Terms and Conditions.
(3) Users undertake to use the profiles, information, and contact data provided via the matching portal exclusively for the purpose of personal exchange and initiation of a stay as a Senior Aupair. Disclosure of personal data obtained via the matching portal to third parties as well as use for commercial or other non-contractual purposes is not permitted.
(4) The Agency assumes no guarantee for the accuracy, completeness, or currency of the information and profiles posted by users. Users are responsible for the information they provide.
(5) The Agency is entitled to temporarily or permanently block access to the matching portal if concrete indications exist that a user has violated or is violating these General Terms and Conditions or applicable law, or if another legitimate and substantial interest in blocking exists. When deciding on a block, the Agency appropriately considers the legitimate interests of the affected user.
(6) Users undertake to provide complete and truthful information required for registration and use of the matching portal and to update changes to their contact data without delay.
(7) The processing of personal data takes place in accordance with the Agency’s privacy policy.
(8) For the execution and processing of the use of the matching portal, the following data are required: first and last name, address, email address; for entrepreneurs also company name and VAT ID number. Depending on the product, further necessary data may be required.
(9) For paid services, the information regarding the name, particularly the company name, must be correct. The same applies to the address. Invoices and other documents and content are created based on this information. Should corrections become necessary, this may result in additional effort, which will be charged at a reasonable amount. Therefore, changes to email address/data must be communicated immediately and without delay.
§7 Rights of Use to Digital Content or Documents
Audio, video, and PDF files, accompanying emails, and other documents may be used by users/customers only for their own use. All other rights of use to the files, concepts, content, and documents remain reserved to the Agency. This means that the content and conveyed knowledge may not be made accessible to third parties.
Furthermore, the creation of content for third parties, the transfer or forwarding of content to third parties, or any other exploitation for purposes other than the user’s own use and/or study purposes, during and also after the end of the cooperation or use, requires the Agency’s express prior written consent.
§8 Liability
The Agency is liable exclusively for intent and gross negligence.
The Agency is not liable for information, documents, or behavior of aupairs or host families, damages or obligations arising between aupair and host family, downtime due to cancellations, visa delays, or similar circumstances. Liability for delays or damages caused by public authorities or (un-)involved third parties (e.g., airports, health authorities, etc.) is excluded.
§9 Data Protection and Confidentiality
Personal data are processed exclusively within the scope of the mediation activity. Disclosure occurs only insofar as it is necessary for the mediation process (e.g., to partner agencies or service providers).
Users undertake to treat all personal data confidentially and not to disclose it without authorization or without written consent.
§10 Final Provisions
Individual agreements between the Agency and the customer take precedence over these General Terms and Conditions.
Should a provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by the statutory regulation.
Amendments and supplements to these General Terms and Conditions require text form.
The law of the Federal Republic of Germany applies. The UN Convention on Contracts for the International Sale of Goods (General Terms and Conditions) is excluded.
Place of jurisdiction is Berlin, Germany.
These GTC apply in their respectively current version and are available on the Agency’s website.
